‘Ambarsar’ or ‘Amritsar’: Mall naming goes to high court | Chandigarh News


CHANDIGARH: The matter of naming of a mall in Punjab’s Amritsar city has gone before the Punjab and Haryana high court. It all began when the Amritsar deputy commissioner (DC) issued notice to a city mall asking its owners to change the name of his mall VR Ambarsar and replace it with Amritsar.
However, hearing the plea filed by the owners of the mall, the Punjab and Haryana high court on Tuesday stayed the notice issued by DC Amritsar. The DC had issued the notice on the basis of a complaint received from Vipul Talwar, president Jai Punjab Welfare Society, claiming hurting of religious sentiments because of the use of the name “Ambarsar” by the mall.

The HC has also issued notice to the Punjab government, Amritsar DC and the society seeking their replies on the issue.
While staying DC’s order, Justice Lisa Gill of the HC orally observed that the religious sentiments of the society have become so fragile with emotions and wounded easily that complaints are being filed on such petty issues these days.
Justice Gill has passed these orders while hearing a petition filed by Alena Ventures Pvt Ltd on behalf of the mall challenging the order dated April 23 passed by the Amritsar DC asking the mall to remove the word ‘Ambarsar’ from its name. It was stated in the DC’s order that the name of the city is ‘Amritsar’ in government notifications and changing nomenclature to “Ambarsar” is wrong.
The petitioner contended that the city Amritsar is colloquially known as Ambarsar. The word Ambarsar has also been used in various movies, shops, songs, etc. There is a market which is also known as Ambarsar Bazaar. Ambarsariya di Hatti, Ambarsar Badiyaan, has been used at various places and there is no bar in using the word Ambarsar as per the Emblems and Names Act (Prevention of Improper Use) Act, 1950.
Counsel for the petitioner senior advocate Chetan Mittal contended that the IK Gujral Punjab Technical University – Amritsar Campus which is a state university has also mentioned that the city of Amritsar is colloquially known as Ambarsar. There are various news articles and social media pages which claim that the word Ambarsar is an emotion and not just a word and they prefer to call it as Ambarsar.
It was also contended that there are various cities with colloquial names like Benaras which refer to the city of Varanasi and Delhi is also known as Dilli. However, the same does not mean to have changed the name of the city, Mittal had argued.
Even under various statutes there is no bar in naming or using the word Ambarsar. However, the Amritsar DC did not consider any of the above contentions and passed such an illegal order without any jurisdiction and reasoning.
The senior counsel representing the petitioner also contended that Jai Punjab Welfare Society, which made a complaint to DC regarding the name of the mall, ‘’is a busy body and has referred in the complaint as hurting the religious sentiments”.
Otherwise, there is no such prohibition in any of the Acts which is remotely dealing with names etc., be that the Emblems and Names Act (Prevention of Improper Use) Act, 1950 or the Trademarks Act, etc. “Using the name does not even hurt the religious sentiments,” the senior counsel had submitted.
